STATUTE OF THE OPEN ARCHITECTURAL TENDER

WITH INTERNATIONAL PARTICIPANTS INVOLVED Archchel-2020

1. GENERAL PROVISIONS

1.1. The tender of architectural projects (hereinafter referred to as the Tender) is an open architectural and construction design tender aimed at architectural and planning solutions of the three objects being developed at the option of the Participants. The objects are as follows: the Airport; the Congress Centre; the Embankment of the Miass from Pr. Sverdlovsky Street to Lobkova Street; (hereinafter referred to as the tender objects).

1.2. The tender is supported by the Ministry of Economic Development of the Chelyabinsk region, the Ministry of Culture of the Chelyabinsk Region, the Main Directorate of Architecture and Urban Development, the Ministry of Construction and Housing of the Chelyabinsk Region.

1.3. The tender organizer:

Independent non-profit organization «Chelyabinsk region International Cooperation Agency»;

the Union of Russian Architects;

the Union of Russian Designers.

1.3.1. The Organizer committee approves the Statute of the Tender as well as the documents being Appendices to the Statute of the Tender and monitors them being observed.

1.4. The customer of the tender: the Government of the Chelyabinsk Region

1.5. The organizational committee is created for the Tender.

1.6. The aim of the tender – to obtain modern city-planning and architectural design solutions of the tender objects on a competitive basis and identify the best projects in accordance with the tender documents. The tender laureates’ projects will be recommended for implementation by the Government of the Chelyabinsk Region in the framework of the events being prepared and held while the Russian Federation presiding in the SCO and BRICS.

1.7. The main goals of the tender:
- to identify and assess the best three-dimensional and architectural and planning solutions, combining high functionality and economic effectiveness;
- to create balanced urban environment in the area of a large social and cultural centre being developed;
- to make up a catalogue of architectural and planning solutions addressed to potential customers for the preparation for events being held while the Russian Federation presiding in the SCO and BRICS.

1.8. The announcement of the Tender, this Statute and the documents stipulated by the Statute, all other information related to the Tender is available at archchel2020.ru. The announcement of the Tender is also posted at the official website of the Government of the Chelyabinsk Region gubernator74.ru.

1.9. Applying for the Tender the author of the project agrees with the following: to have the information which he sent to the Tender Organizer by e-mail reproduced on a material medium; to have his tender project demonstrated to the public; to have the contents of his tender project being sent brought to public knowledge including publishing at the website of the Tender, websites of the Tender Organizational Committee members, other theme-based websites as well as his personal data being used.

1.10. After the end of the Tender the Organizational Committee gets the right to the content sent to the Tender further being reproduced with the author’s name being indicated without the consent of the author of the architectural project. The Customer of the Tender has the right to use certain solutions proposed by the Participants of the Tender. The rights to use the architectural projects submitted by the Participants of the Tender of architectural projects are transferred by the Participants to the Customer of the Tender without time and area of usage being limited in compliance with the intellectual property law of the Russian Federation.

1.11. The participants of the Tender selected by the Organizational Committee get the right to be involved in the development of the working draft based on their sketch architectural projects. The work the participants of the Tender will perform while their sketch architectural projects being implemented will be discussed in special contracts with the customer.

1.12. While the architectural project is being implemented the Customer of the tender has the right at his option:

1.12.1. not to implement certain parts (solutions) of the architectural project;

1.12.2. to demand from the participant of the tender to modify the solutions being included in the architectural project.

1.13. The Customer can refuse to implement the architectural project in case the Project of the Object being constructed is changed. The participant of the tender has no right to demand from the Customer any losses to be compensated due to such a refusal except as otherwise is specified in the appropriate engagement (contract). The Participant of the tender has no right to demand from the Customer any losses to be compensated due to any delay of the Project being implemented except as otherwise is stipulated by the contract between them.


2. ORGANIZATIONAL COMMITTEE

2.1. The status of the Organizational Committee of the Tender

2.1.1. The Organizational committee is the main governing body of the Tender.

2.2. The rules of procedure of the Organizational committee of the Tender

2.2.1. The Organizational committee acts on a free-of-charge basis through holding meetings and making decisions being recorded.

2.2.2. The Organizational committee is authorized to make decisions only with more than a half of all the members of the Organizational committee being present at the meeting.

2.3. The powers of the Organizational committee of the Tender

2.3.1. The Organizational committee defines the rules, time frame and procedure of participation in the events being held within the Tender framework.

2.3.2. The Organizational committee invites media partners of the Tender, posts information about the Tender at the official website of the Tender, websites of the Organizational committee members and in other media, holds different events as a part of informational and advertising campaign of the Tender, ensures the results of the Tender being disclosed.

2.3.3. The Organizational committee informs of the start and time frame of the Tender, procedure of participation and giving awards.

2.3.4. The Organizational committee lays down requirements to the tender projects and assessment criteria.

2.3.5. The Organizational committee receives the Participants’ messages, information and documents including Applications and Tender proposals;

2.3.6. The Organizational committee decides to disqualify the participants who broke the terms of the Statute of the Tender.



3. PARTICIPANTS OF THE TENDER

3.1. The tender is open. Design organizations, architectural workshops, certified architects, engineers, design engineers are invited to participate in the tender. All architects with or without a certificate of SRO access can take part in the tender.

3.2. A legal entity involved in architecture, an individual person, a group of a maximum of 5 people whose status meets the requirements indicated in the present Statute can participate in the tender.

3.3. The participants of the tender have the right to provide one application for each nomination.

3.4. Members of the organizational committee, jury, expert groups as well as their family members can neither take part in the tender nor advise anybody on this issue.




4. REGISTRATION OF THE PARTICIPANTS OF THE TENDER

4.1. The tender is free of charge.

4.2. By September 19, 2021 those willing to participate in the tender should email certain documents to archchel2020@archchel2020.ru, e-mail address of the Organizational committee of the Tender and after that send them by post to ANO Agency of International Collaboration of the Chelyabinsk region, located at Office 609, 55a, pr. Lenina Street, Chelyabinsk, 454091. The documents are as follows:

4.2.1. An established application form for participation filled:
- for individual participants and groups of people not being legal entities in (Appendix 1 to the present Statute)
- for legal entities (Appendix 2 to the present Statute)
with the chosen design object being indicated (the Airport; the Congress Centre; the Embankment of the Miass from pr. Sverdlovsky Street to Lobkova Street).

4.2.2. Copies of the documents for individual participants:
- a copy of an ID document (for foreign citizens)
- a copy of diploma
- banking details

4.2.3. Copies of the documents for legal entities:
- certificate of entry in the Unified State Registry of Legal Entities
- banking details

4.2.4. Declaration of authorship (Appendix 3 to the present Statute)
4.3. The application form for a group of people not being a legal entity as a Participant is filled in with the personal data of the creative group leader being its representative in charge. In case the Participant’s architectural project is awarded with a prize-winning place, the creative group leader gets the prize money with all financial issues being solved within the creative group.

4.5. The Organizational committee of the tender conducts official registration in the list of the Tender participants based on 4.2., assigns the Registry Identification Number to the Tender Participant and sends him a package of tender documents (preliminary specifications, initial design data) in accordance with the chosen sketch design object (the Airport; the Congress Centre; the Embankment of the Miass from pr. Sverdlovsky Street to Lobkova Street).

4.6. The Participant of the Tender is responsible for reliability of the personal data being submitted. The data indicated by the Participant must be supported with the documents upon the request of the Organizational Committee of the Tender.

4.7. Submitting the documents for participation, the Participant by this confirms the following:

4.7.1. his authorship to the project (any copying will lead to disqualification);

4.7.2. his consent and the consent of the third parties (if they are mentioned in the presentation being submitted) to participate in the Tender, to have the application being used at the tender Organizer’s discretion including publishing in the Internet and mass media;

4.7.3. his consent that in case of any claims laid by the third parties the materials are excluded from the Tender;

4.7.4. in case of any claims laid by the third parties, the Participant of the tender is fully responsible for the rights of the third parties being violated;

4.7.5. his consent that if the fact of violation of the conditions of the Tender or the copyright to the submitted project is revealed after the awarding ceremony, all the awards and prizes are cancelled and are to return to the tender Organizer.

4.8. The Organizer retains the right to request additional information concerning the design solution from the Participant in case the information being submitted is not enough to make a decision.



5. ANONYMITY

5.1. Tender proposals are provided only under identification numbers. The materials being provided must not contain any information pointing at the name of the Tender participant.

5.2. The representative of the Organizational Committee of the Tender who registered applications for participation and assigned registry identification numbers to the Participants is responsible for the authorship to the architectural project being kept anonymous.

5.3. Information concerning authorship to the project indicated in the application is revealed only after the jury's verdict. The organizational committee of the tender guarantees confidentiality of personal data (the Federal law of July 27, 2006 № 152-FZ «On personal data») he got to know during the Tender with the exception of them being used for the specified purpose.

5.4. All the Participants are obliged not to publish their architectural projects (both in full or any parts) until the results of the Tender are summarized.


6. INITIAL DESIGN DATA

6.1. The participants of the tender receive the documents and materials which are necessary for their work on the tender project comprised of:

6.1.1. For the object referred to as the Airport:
- diagram of the General plan of the area under design on a scale 1 : 1000;
- photofixation of the objects and the territory.

6.1.2. For the object referred to as the Congress Centre:
- diagram of the General Plan with the boundaries of the area under design on a scale 1 : 1000;
- protocol requirements to the facilities for main summit events and functional premises.

6.1.3. For the object referred to as the Embankment of the Miass from pr. Sverdlovsky Street to Lobkova Street:
- diagram of the General plan of the area under design on a scale 1 : 2000;
- panoramic photo of the area;
- photofixation of the objects;
- sketch of the ground entrance to the metro station;
- sketch of the panoramic wheel near the shopping and entertainment centre Megapolis;
- art public garden.


7. PROCEDURE AND REQUIREMENTS TO THE COMPOSITION, CONTENTS AND EXECUTION OF THE TENDER PROPOSALS

7.1. Tender proposals are accepted until 6 p.m. of November 18, 2021.

7.2. The tender proposal is provided in an electronic form and is supported by three sketching boards, the size of 1000 х 1400 mm, portrait orientation. The name of the object under design (the Airport, the Congress Centre, the Embankment) is indicated in the left part of a horizontal rectangle, the size of 1000 х 1000 mm, at the top of each sketching board on white background typed in Arial (150 p), the identification number being assigned to the Participant is provided in the right part. The identification number is also pointed out on the first page of the explanatory note.

7.3. The Organizational committee of the tender is responsible for tender proposals being printed and sketching boards being made for demonstration of the projects

7.4. The composition of the tender proposal for the object being referred to as the Airport:
- general location plan;
- diagram of the General plan on a scale1:1000;
- traffic diagram;
- floor plans (ground and normal ones) планы этажей;
- typical sectional elevations;
- facades;
- facades being developed;
- imaging (the model being optional);
- fragments and details (optionally);
- explanatory note.

7.5 The composition of the tender proposal for the object being referred to as the Congress Centre:
- general location plan;
- diagram of the General plan on a scale1:1000;
- traffic diagram;
- floor plans (ground and normal ones) планы этажей;
- typical sectional elevations;
- facades;
- facades being developed;
- imaging (the model being optional);
- fragments and details (optionally);
- explanatory note.

7.6. The composition of the tender proposal for the object being referred to as the Embankment of the Miass from pr. Sverdlovsky Street to Lobkova Street:
- general location plan;
- diagram of the General plan on a scale1:1000;
- sections;
- technical and economic indices;
- traffic and pedestrial diagram;
- imaging;
- fragments and details.


8. JURY

8.1. The Jury is the working body of the Tender. The Jury acts in compliance with the provisions of the Tender documents.

8.2. The procedure of the Jury work

8.2.1. The next day after the date the projects are to be submitted the members of the Jury receive e-mails with the Participants' projects being attached for preview.

8.2. The projects are sent to the members of the Jury with the authors' names being kept anonymous.

8.2.3. The members of the Jury are invited by the Tender Organizer for face-to-face meetings in the city where the Tender is held.

8.2.4. The representatives of the Organizational committee of the Tender are present at the meeting of the Jury. The chairman of the Jury presides over the meeting.

8.3. The chairman of the Jury

8.3.1. The chairman of the Jury is appointed by the decision of the Organizational committee.

8.3.2. The powers of the Chairman of the Jury:
- presiding over a meeting;
- accepting proposals on the agenda of the meeting from the members of the Jury;
- making proposals for the agenda of the meeting;
- stating the agenda and draft decisions;
- moderating the agenda being discussed;
- approving the protocol of the Jury’s meetings.

8.4. The Secretary of the Jury
8.4.1. The Secretary of the Jury is appointed by the Organizational committee of the Tender and is not a member of the Jury.

8.4.2. The Secretary of the Jury provides material and technical support of the Jury meetings, executes protocols of the Jury meetings.

8.5. The protocol of the meeting.

8.5.1. Proceedings of the Jury meeting, opinions being voiced, decisions being taken and vote results are recorded in the protocol of the Jury meeting.

8.5.2. The protocol of the Jury meeting is signed by the Chairman, the Secretary, all members of the Jury.

8.5.3. One copy of the protocol of the Jury meeting is drawn up.

8.5.4. The protocol (the extract from the protocol) of the Jury meeting with the taken decision being stated is posted at archchel2020.ru.

8.6. Voting and decision making process

8.6.1. The Jury meeting is legitimate with only more than a half of the members of the Jury being present at the meeting.

8.6.2. The decision of tender projects being ranked is taken by each member of the Jury individually.

8.6.3. Each project is assessed on a 10-point grading scale. The assessment criteria for architectural projects are determined by the Preliminary specifications.

8.6.4. The points are put down in assessment sheets. The winners are revealed after all the points are summed up. In case the Tender projects of two or more Participants get the equal number of points, an additional vote of the Jury is taken to choose the Winner. In this case each member of the Jury has one vote. If the votes are equally divided the vote Result is brought up for discussion by the Jury, the final decision upon the Winner is taken by the chairman of the Jury.

8.7. The Jury verdict is to be published at archchel2020.ru on the day of the verdict being reached.

8.8. The authors of the projects are revealed by the Organizational Committee only after the verdict of the Jury being reached and published.

8.9. The members of the Jury are determined by Appendix 4 to the present Statute.


9. DISQUALIFICATION OF PARTICIPANTS

9.1. A participant can be disqualified from his further participation in the Tender on the following grounds:

9.1.1. the architectural project submitted by the Participant does not comply with the provisions of the Tender documents in terms of composition and content;

9.1.2. the architectural project is submitted with the terms of submission being violated;

9.1.3. claims concerning copyright violation are laid by the third parties to the Participant of the tender;

9.1.4. the architectural project does not comply with the legislation of the Russian Federation including city planning standards of the subject of the Russian Federation, municipal structures;

9.1.5. the architectural project does not meet the rules of morality and ethics, the Participant of the tender promotes immoral behavior;

9.2. The Jury makes the decision to disqualify the Participant.

9.3. The architectural project submitted by the Participant being disqualified is not considered while choosing the Winner.


10. REWARD OF THE WINNER

The winners of the tender will be awarded with the following prizes:

10.1. For the object referred to as the Airport: for the first place in the amount of 1, 100, 000 (one million one hundred thousand) rubles, for the second place in the amount of 500, 000 (five hundred thousand) rubles, for the third place in the amount of 300, 000 (three hundred thousand) rubles.

10.2. For the object referred to as the Congress Centre: for the first place in the amount of 1, 500, 000 (one million five hundred thousand) rubles, for the second place in the amount of 800, 000 (eight hundred thousand) rubles, for the third place in the amount of 500, 000 (five hundred thousand) rubles

10.3. For the object referred to the Embankment of the Miass from pr. Sverdlovsky Street to Lobkova Street: for the first place in the amount of 1, 300, 000 (one million three hundred thousand) rubles, for the second place in the amount of 600, 000 (six hundred thousand) rubles, for the third place in the amount of 400, 000 (four hundred thousand) rubles.

10.4. The prize money is paid to the Winners in compliance with the current legislation of the Russian Federation.

10.4.1. If an in individual person being a resident of the Russian Federation is considered the Winner of the Tender, the prize money is paid with the income tax in the amount of 13 (thirteen) percent of the prize money being deducted in compliance with point 28, Article 217 of the Tax Code of the Russian Federation (hereinafter – the Tax Code).

10.4.2. If an in individual person not being a resident of the Russian Federation is considered the Winner of the Tender, the prize money is paid with the income tax in the amount of 30 (thirty) percent of the prize money being deducted in compliance with point 3, Article 224 of the Tax Code.

10.4.3. If a legal entity is considered the Winner of the Tender, no tax is levied upon the prize money as the Tender Organizer applies a simplified taxation system in compliance with Article 346.11 of the Tax Code.

10.4.4. If a legal entity being a foreign organization is considered the Winner of the Tender, the prize money is paid in compliance with Article 310 of the Tax Code.

10.5. The prize money is paid not later than within 30 (thirty) working days after the Jury verdict of the Winner being chosen concerning each object (the Airport; the Congress Centre; the Embankment of the Miass from pr. Sverdlovsky Street to Lobkova Street).

10.6. The organizers and partners of the tender can establish special prizes (valuable gifts) for the participants of the tender.

10.7. All prize money is paid in Russian rubles.

10.8. The Winners of the tender will be awarded with laureate Diplomas together with the prize money.

10.9. The best projects will be published in the catalogue and at the official website of the Tender archchel2020.ru.

10.10. All tender projects will be displayed at a free exhibition. The place and terms of the projects being exhibited will be further provided at archchel2020.ru.


11. TIME FRAME OF THE TENDER

11.1. The tender is announced on August 4, 2021.

11.2. The applications for participation in the tender are accepted and registered until September 19, 2021.

11.3. The projects are submitted until November 18, 2021.

11.4. The electronic versions of the projects are sent to the members of the jury for preview in the period from November 21, 2021 to November 23, 2021.

11.5. The projects are being considered and the Jury verdict is reached in the period from November 28, 2021 to November 30, 2021.

11.6. The Jury verdict is published on December 01, 2021.

11.7. The awarding ceremony will take place on December 02, 2021.
